Terms of Use

Daily Report helps construction professionals create daily reports. You speak or type what happened on a jobsite, and the app uses AI to organize your words into a structured report that you can review, edit, sign, and export as a PDF. A finished report can carry an integrity record (time, GPS location, your signature, the preserved voice recording, the transcript, the app version, and the device model) intended to make it more credible and harder to dispute. That is a design goal, not a legal guarantee; see Section 7.

When Cloud AI is on (the default) and you are online, the text of your report is sent through our server to Google Gemini (paid API tier) to be organized and returned to your device. On iPhone, speech-to-text runs on the device and audio never leaves it. On Android, your voice recording is sent to Groq to be transcribed, and Groq is also the backup for organizing Android report text when Gemini is unavailable. Our server does not store your content or log the content of requests, and our AI providers do not use it to train their models. On iPhone you can switch to On-device mode, which runs the AI on the phone. The Privacy Policy has the full details.

The apps have no account and no sign-in.

You must be at least 18 and able to form a binding contract. The Service is for business and professional use, not personal, family, or household use. If we later offer accounts, you will be responsible for accurate account information, for keeping your sign-in private, and for activity under your account, and you should tell us promptly at contact@constructioncopilot.com about any unauthorized use. We will never ask for your password by email, text, or phone.

The reports, PDFs, text, recordings, photos, signatures, and other content you create with the Service belong to you (or to the employer or organization you create them for). We claim no ownership of them. You give us only the limited, non-exclusive permission we need to run the Service for you: processing your content through the providers named in the Privacy Policy, at your direction, so the app can build your report and return it to you. This permission ends when the request is complete. We do not sell your content, do not use it for advertising, and do not let our AI providers use it to train their models.

This is the most important term in this agreement. The AI in Daily Report is a drafting aid. You are the author of record and the final authority on every report you send.

• Before you send, share, sign, or submit any report or PDF, you are responsible for reviewing it and confirming it is accurate and complete.
• If a draft does not say what you mean, edit it until it does, or do not send it. Sending a report is your decision and your statement; you adopt its contents as your own.
• We are not responsible for the contents of any report you choose to send, for decisions made based on it, or for the consequences of an error you did not catch before sending.

AI can mishear speech, add details that were not said, leave out things that were said, or format information incorrectly. Treat every draft as a starting point that you must verify.

Transcription, organization, and any translation in the Service are machine-assisted and may contain errors. They are produced by automated systems, not by a human professional, and are not guaranteed to be accurate, complete, or fit for any purpose. You must verify them (Section 4).

If the Service offers translation of Spanish-language voice input into an English report, the translation is machine-assisted and is not a certified human translation. It may contain errors that change meaning. The original Spanish transcript and audio are the source of record and control in any question or dispute. Verify any translated report before relying on it, especially for safety, hazards, instructions, quantities, dates, money, or contract terms. If you need a legally reliable translation, get a certified human translation.

The Service is a documentation tool. It does not give legal, safety, engineering, insurance, accounting, or other professional advice, and using it creates no professional relationship with Weigh Anchor. You remain responsible for complying with the contracts, codes, regulations, and safety requirements that apply to your work and your reports.

Daily Report is designed to produce credible, well-documented records. That describes the design; it is not a promise that any report will be admitted into evidence or accepted by any court, arbitrator, agency, or other tribunal, or treated as conclusive. Admissibility depends on the forum’s rules, the facts, the parties’ conduct, and other factors outside our control. We make no promise about the admissibility, weight, or legal effect of any report. If you need a record for a legal proceeding, consult a qualified attorney.

Your reports, photos, recordings, and PDFs are stored only on your device. We keep no copy and cannot recover them. You are responsible for exporting, backing up, and preserving any report you may need for a project record, claim, audit, or legal proceeding, including any document-retention or litigation-hold duty that applies to you. Deleting the app, losing the device, or a device failure will permanently destroy your reports, and Weigh Anchor is not liable for that loss.

The phone apps are free. The features the phone apps have today will stay free; we will not move them behind a paid plan. We may later offer optional paid plans, for example for cloud backup, company workspaces, or stronger AI. Before anyone can buy one, we will name the payment processor (Stripe) and update the Privacy Policy and these Terms. Before you buy, we will show the price, the billing period, how renewal works, and how to cancel. For any subscription we sell, we commit to: the price and billing period shown clearly before you buy; a plain statement that the subscription renews automatically unless you cancel; cancellation at any time, effective at the end of the paid period; no price increase without the notice and consent the law or the app store requires; and free trials, if offered, that disclose when and at what price they convert. Purchases made through Apple or Google follow their billing, cancellation, and refund rules; there, a subscription renews unless you cancel at least 24 hours before the period ends, in your Apple ID or Google Play settings. We do not receive or store full payment card numbers.

You agree to use the Service only for lawful purposes. You agree not to:

• Use the Service for any illegal, fraudulent, or deceptive purpose, including creating a report you know is false.
• Record or upload content you have no right to capture, or that violates another person’s privacy or rights.
• Reverse engineer, decompile, or disassemble the Service, except where the law does not allow this restriction.
• Copy, modify, distribute, sell, sublicense, rent, or make derivative works from our software (this does not apply to your own reports).
• Use bots, scrapers, or other automated means that burden or interfere with the Service or our processing server.
• Try to gain unauthorized access to any system, or interfere with the security or integrity of the Service.
• Introduce malware, or remove any copyright, trademark, or proprietary notice.
• Use our name, logo, SDVOSB status, or branding without our written permission.

We may suspend or end access for conduct that violates this Section and may report unlawful activity to the authorities.

The Service, including its software, designs, report templates, integrity record, and underlying technology, is owned by Weigh Anchor LLC or its licensors. “Daily Report,” “Construction Copilot,” “Weigh Anchor,” and our logos are our trademarks. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the app for your own business documentation, subject to these Terms. We reserve all other rights. Our IP is the software; the reports you create are yours (Section 3).

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. To the fullest extent the law allows, Weigh Anchor disclaims all warranties, including merchantability, fitness for a particular purpose (including any legal, evidentiary, regulatory, or safety purpose), non-infringement, and title; the accuracy, completeness, or timeliness of any content, transcription, summary, or translation; and that the Service will be uninterrupted, secure, or error-free. AI output can be wrong or made up, and you are responsible for reviewing it (Sections 4 and 5). Some places do not allow these exclusions, so some may not apply to you.

To the fullest extent the law allows, Weigh Anchor LLC and its owners, members, employees, contractors, agents, and affiliates are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising from or related to: your use of or inability to use the Service; any report, PDF, transcription, translation, or other output, including any error in it or content you chose to send; any decision, claim, fine, or loss based on a report or the Service; the admissibility or weight of a report; loss of or unauthorized access to your content, including loss described in Section 8; or any interruption, failure, or security incident affecting the Service or a third-party service it relies on.

Our total liability arising from or related to the Service or these Terms will not exceed the greater of (a) one hundred U.S. dollars ($100) or (b) what you paid us for the Service in the 12 months before the event giving rise to the liability. These limits apply even if a remedy fails of its essential purpose. Where the law does not allow these limits, our liability is limited to the maximum extent the law allows.

You agree to defend, indemnify, and hold harmless Weigh Anchor LLC and its owners, members, employees, contractors, agents, and affiliates from all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from the content of any report you create, send, share, sign, or submit; your use of the Service; your violation of these Terms; or your violation of any law or anyone’s rights, including privacy, recording, or labor-related rights. This survives termination.

The Service relies on third-party providers, currently Apple, Google (including the paid Gemini API), Cloudflare (our processing server), Groq (Android transcription and backup report organizing), and Vercel (which hosts our website and the in-app announcements file). If we add a provider that receives your content, we will name it in the Privacy Policy first. Features that depend on these providers may also be subject to their terms, and we are not responsible for their acts, omissions, or availability. When the app shares a PDF, it uses your device’s share sheet to the destination you choose.

You may stop using the Service at any time and delete the app (see Section 8: deleting the app deletes your reports). We may suspend or end access to the Service, with or without notice, if you violate these Terms, if the law requires it, or if we discontinue the Service. Sections 3 through 8 and 11 through 18 survive termination.

Washington law governs these Terms and any dispute about them or the Service, without regard to conflict-of-laws rules. Before starting any formal proceeding, you agree to email us at contact@constructioncopilot.com with a description of the dispute and to try in good faith to resolve it for at least 30 days. Any action must be brought only in the state or federal courts located in Snohomish County, Washington, and you consent to their jurisdiction. To the extent the law allows, disputes will be resolved only on an individual basis and not as a class, consolidated, or representative action.

Changes. We may update these Terms. We will post the new version with a new version number and effective date, and for significant changes we will give notice in the app or on this site before they take effect. If you keep using the Service after that, you accept the updated Terms; if you do not agree, stop using the Service.

Everything else. These Terms and the Privacy Policy are the entire agreement between you and Weigh Anchor about the Service. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest stays in effect. Not enforcing a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them, for example in a merger or sale of assets. We are not liable for delays caused by events beyond our reasonable control. The Service is operated from and intended for the United States, and you agree to follow U.S. export control and sanctions laws.

Apple and Google. If you got the app from the App Store or Google Play, these Terms are between you and Weigh Anchor, not Apple or Google, and Apple and Google are not responsible for the app or claims about it. Apple and its subsidiaries are third-party beneficiaries of these Terms solely to enforce this paragraph for App Store distribution.

• Version 2 (this version). Describes app version 1.2. Names Groq as the backup for organizing Android report text and Vercel as the host of the announcements file. Section 9 no longer says future purchases would go only through Apple or Google; it now names Stripe as the payment processor to be used, promises updated policies before anyone can buy, and commits that the phone apps’ current features stay free. Court venue moved from King County to Snohomish County, where the company is based. Removed the description of future cloud features from Sections 2 and 3. States that Construction Copilot is a trade name of Weigh Anchor LLC.
